The plaintiff sued for $150 damages on the grounds that s. horse owned by Glazer had kicked a. horse owned by the plaintiff and which the plaintiff kejit in the barn with the permission of Glazer. The justice agreed with Glar.er that the plaintiff 5. horse had been kicked by a horse likewise envned by tho plaintiff and not by a horse owned by Glazer. The justice found against Glizer in a suit brought against James Luther. The evidence was that Glazer had hold two horses to one Tomlinson, and that before they were paid for Tomlinson's wife had sold one of them to Luther. Glazer sued to replevy'the horse from Luther em the grounds that he had retained a note which gave title in the property to the vendor until the purchase prie had been paid.
