APPEAL TAKEN ON FINAL ASSESSMENT Court ts Asked to ApiHint IVixni Iteassess lnnis InK?rty l'or Server IicncJits. to Claiming excessive assessment against their property on account of the Bowman creek sewer, Mary R. Riley and William R. Innis. executor of the estate of Dora L. Innis, in action brought in the circuit court Friday afternoon against the city and theboard of public works, ask that t!n; court appoint three disinterested freeholders to make a reassessment. The property is on Scott st. and the assessment is $lG,X4G..r)0. It is alleged in the complaint that the contract for the sewer was let on May 20, 1113, and that the assessment against the lnnis property was $19,846.50. Following a remonstrance on the part of the plaintiffs this assessment was reduced by $".000 on March 9, F.H5, which amount waa still considered to be excessive. It is said that the property in question is suitable at the present time onlj- for farming purposes and that It receives no benefit from the sewer which is merely a sanitary sewer and not built to take care of the overllow from Bowman creek. It is pointed out that the nearest point of tho sewer to the property is a quarter of a mile distant on Michigan st. and that the benefits from it to the property are merely speculative. It is declared that it will be many years before the property can be used for city lots and that then It will be necessary to build a lateral sewer at much expense to care for the lots.
