It is further alleged that after the plant was ir operation the controlling stockholders of the South Rend company repudiated the acts of Theodore Thorward in ouilding the dalien plant claiming tint there had been a misappropriation of the South Rend corporation- prop rty. It is paid that thee stockholders demanded that Theodore Thorward reimburse the South Rend company for the amount of money secured on the credit for the erection of the Ialien plant. Thorward agreed to do this and lie and his wife and sn put up as collateral to secure this payment, certain stork in the South land company. This was done in l'.ll. Thorward dad in 1'JIS.
