Case Brought Up in Court and Sheriff Bailey Allows Them to See Client Today Arguments to Be Made Monday. Quill.-ot, Sheriff Bailey appeared b'foro tho court Friday afternoon at o o'clock to show cause why counsel for Quilhot should not be permitted to confer with their client in tho J :ii I whenever they should wish to do so. Arguments in tho case were vet for Monday afternoon at :;.10 o'clock, with (ho agreement, made ouLs!di tlie rcc rd, that t-aid counsel rniht vi.sit their client at any time durinp Saturday. In their petition the plaintiffs, Weidler, Parker v I'tttenmli, alleged that they had been barred from the presence of their client except on the regular visitors' days which fall on "Wednesday of each week. liailey v. as represented in court by Samuel Parker, of tho firm of Anderson, Parker, Crabill Crumpackrr. Famuel Parker FUffcsted to the court that inasmuch as tho court was weary after ;i hard day's work it might be well to continue the hearing until Monday, lie taid that there was a nice question to be threshed out and ho would be pleased to have more timo to consider it inasmuch as ho had been retained but a short time previous to tho timo set for the hearin fT. He announced to Pettenglll that the sheriff would be willing to permit any one of Quilhot's lawyers, or all three of them, to visit Quilhot whenever they rhould choose to viit him on Saturday. Pettcngill replied that all they wanted waa to be permitted to visit their client and that if they were to be given this permission that there was nothing to try beforo tho court. To this the court said that as the action involved a matter of rights it would have to be tried out unless it were compromised. pettcngill then asked that he and his associates be permitted to visit Quilhot before Saturday inasmuch as they had not seen him for 4S hotrs. Counsel for Pailey would not consider such a proposition. Pettcngill then insisted that the arguments be taken up at once ami Parker agreed to this saying that lie was ready to proceed if counsel for the defense insisted, i'nso Is mtinuel. Judge Funk however decided that tho emergency was not fo grVat but that the case could go over until Monday afternoon and so he ordered that this be dene. It was agreed that tho arrangement whereby counsel for Quilhot was to be permitted to visit him on Saturday would not prejudice the case for tho defense. The petition for a writ of mandamus was filed late Friday forenoon. It was alleged by tho relator that it was necessary that counsel for Quilhot be permitted to consult with him for tho purpose of planning for a new trial or for an appeal in tho case by which ho is now in Jail. If this could not bo arranged it was alleged that thero was a necessity to have a conference for the purpose of arranging for tho payment of his fine by Quilhot. It was alleged further that Petteng1ll ami Orie I'arker had called at the iail on Thursday afternoon at 3 o'clock and had been refused admittance when they asked to sco and consult with their client. The two anarchists will be heard by Judge Swann in chambers Saturday. The detective, whom they charge with having bought the materials for the bombs and suggsting that they be placed in tho cathedral, will be examined by the judge on Monday. It is believed now that Abarno and Carbono will plead guilty when they are placed on trial. Their reason for desiring to bo heard by Judge Swann is said to be that they feel they were "framed up" ley the police and that some consideration is due them if they can establish that police influence lee them into the crime they committed.
