do not fix the punishment of the cul
prit, either by law or by seutence. To inflict the punishment of death legally, requires that there should be a law to that effect, there must be

and an executioner to dispatch him. These are all parts of the great machine, and co-operate, and are assential in producing the effect. If there is criminality in the result, that
criminality must attatch to all active
