Kentland Grain Firm Damage Suit Venued to This County.
A case has been venued to Jasper county from Newton in which Warren T. McCray, Morrison & Co., the Kent-, land grain and elevator firm, seek to recover from the Pittsburg, Chicago, Cincinnati & St. Louis railroad, which is a branch of the Pennsylvania system, for a car load of oats damaged by a flood at Wheeling, W. Va. The plaintiffs set out that on March 13th a car of oats, which they had sold to Dowler & Dowler, of Wheeling, arrived in that city. The car was sidetracked on the east of the Ohio river, and the river overflowed its banks and for several days the car of oats was submerged with water. On March 19th Dowler & Dowler discovered that the par was there and that its condi r tion rendered it valueless and* they refused to accept it. The railroad was asked to stand the loss but refused to do so, and the suit was brought. The car contained 1,500 bushels of oats and is valued at $705. Judgment for interest and attorney fees is asked, amounting to SI,OOO in all. The plaintiffs are represented by Judge® Darrocb, of Kentland.
