Grover Smith Ditch Injunction Is Dismissed.
By error the C. I. & S. railroad was given no notice when the petition for the Grover Smith ditch was in court, and the road assessed benefits without having been informed by notice or publication that it was a party to the action. When the officials learned that the road was affected they secured an injunction against the ditch crossing the railroad. The injunction was granted in vacation and came up in the court again Thursday. As the dredge was nowhere near the railroad work was pushed right ahead, and no delay occasioned. But Thursday the injunction was dismissed. : ■’ '•? ■
, It will be necessary, however, for the railroad to replace an 18-foot bridge with one 40 feet in length, and to build a spur out from the main track when the ditch is dug through the right-of-way. A compromise agreement was reached by which the railroad is given damages in the sum of >3OO. They are assessed benefits in the sum of >lB7. The railroad was represented here by Attorneys Chas. H- and G. D. Peters, of Knox.
