Notice is hereby given that the undersigned commissioner, appointed in an action for partition in the Jasper Circuit Court wherein Samuel Hartsell is plaintiff and Samuel H. Hartzell, Elizabeth C. Boone, Lavina V. Blaney, Paul Hartsell, French Hartsell, Mary E: McGinnis, Columbus C. Elcessor, Edward T. Elcessor, Kate E. Kammerer, Ida B. Hastings, William L. Elcessor, Laird R. Elcessor, Eleanor I. Elcessor, Gladys R. ElcesSor. Hettie Graham, John C. Rlshaberger;Harriet Rishaberger, Bertha Stauffer and Maude Stanley are defendants for the partition of certain real estate therein described, to sell the real estate described in the complaint in said cause, I will, as such commissioner, on the 19th DAY OF MARCH, 1909, offer at private sale to the highest and best bidder the following described real estate in said Jasper county, Indiana, to-wlt: Lot No. one (1), in block No. seventeen (17), and lots No’s, one (1), two (2) and five (5), in block No. sixteen (16), all in the original plat of the town, now city, of Rensselaer, Jasper county, Indiana, also the northeast quarter (34) and the northeast quarter (34) of the northwest quarter (34), all in Section thirty-five (35), Township twenty-nine (29) north, Range seven (7) west in said county and state aforesaid, also, the' east half (36) of the southwest quarter (34) of Section twenty-six (26), Township twentynine (29) north, Range seven. (7) west also the north half (36) of the northeast quarter (34) of the northeast quarter (34) of Section thirty-four (34), Township twenty-nine (29) north, Range seven (7) west, also the north half (36) of the northwest quarter (34) of the northwest quarter (34) of • Section thirty-five (35), Township twenty-nine (29) north, Range seven (7) west, excepting a strip of land eighteen (18) feet wide off of the east side of said north half (36) of said northwest quarter (34) of said northwest quarter (34) in said Section, Township and Range aforesaid; also a tract of land described as follows: Commencing at the southeast corner of Section twenty-six (26), Township twenty-nine (29) north, Range seven (7) west, and running thence north a distance of nine hundred fifty-one (951) feet, thence south sixty-four (64) degrees west one hundred (100) feet, thence south fifty-eight (58) degrees west one hundred (100) feet, thence south fiftyone (51) degrees west one hundred sixty-one (161) feet, thence south thirty-two (32) degrees and thirty (30) minutes west three hundred (300) feet, thence south twenty-four (24) degrees west one hundred (100) feet, thence south two (2) degrees and thirty (30) minutes west one hundred (100) feet, thence south eleven (11) degrees and thirty (30) minutes east two hundred thirty-five (235)feetto the south line of said Section twen-ty-six (26), thence east along the south line ‘of said Section twenty-six (26) five hundred eight (508) feet to the place of beginning containing 8.29 acres. Also a portion of the dast half (36) of the southeast quarter (34) of Section twenty-six (26), Township twenty-nine (29) north, Range seven (7) west, described as follows: Beginning at a point five hundred six (506) feet, west of the southeast corner of said Section twenty-six (26), theme west eight hundred twenty-seven (827) feet, thence forth seven hundred nine-ty-seven and one fourth (79734) feet to the center of the Bumkum Public Road, thence northeast on the center line of said road fifteen hundred forty-one (1541) feet to the east line of said section twenty-six (26), thence south seventeen hundred fifty-one (1751) feet to the south line of the Iroquois River, thence down on south and east side of said Iroquois River with the meanders to the south line of said Section twenty-six (26) at the place of beginning, except three and 17/100 acres out of the northwest corner of the above described tract of land described as follows: Beginning at a stone in the center of the public highway known as the Bunkum Road in the center line north and south of said southeast quarter of said Section twepty-six (26) and near the northwest quarter (34) of the' southeast quarter (34) of .the southeast quarter (34) of said Section twenty-six (26K and running thence in an easterly direction following the line of said public highway a distance of two hundred fortyeight (248) feet, thence running south at an angle of eighty-four (84) degrees and forty (40) minutes (as compared with the line of said highway) a distance of three hundred seventy-six (376) feet, thence in a westerly direction parallel with the line of said highway a distance of four hundred forty-six (446) feet to the line dividing said souheast quarter (34) of said Section twenty-six (26) through the center north and south and then due north along said line a distance of four hundred forty-four (444) feet to the place of beginning. Terms of Sale: One-third (34) cash, one-third (36) in six (6) months and one-third (34) in twelve (12) months, purchaser or purchasers to give notes with interest at the rate of six (6%) per cent per annum, secured by purchase money mortgage upon the real estate above described.
