Judge Dismisses Moore Suit.

Forg Moore, formerly a section foreman for the Monon railroad at this place, brought suit against the road for injuries sustained by his son here in 1906. It will be remembered that the boy was jumping on and off the caboose on a freight train when he slipped -and fell in such a manner that one of his tegs was cut off. Agent Beam, Drs. English, Washburn and Kresler, Lyman Zea, W. 8. Richaids and a Norris boy were galled as witnesses and the evidence of the plaintiff was all in a little before noon today, Friday. The judge then instructed the jury to bring in a verdict for the defendant, not even hearing the evidence of the defense. The bby was trespassing on the railroad right-of-'Way and it would establish a dangerous precedent to make a railroad liable under such conditions.
