Injunction Case Gets Another Judge.
And still a third judge is to hear the Ditman ditch injunction suit. Judge Wason, of Delphi, came aver Wednesday evening and held a short session after supper, granting a request for a change of venue from him. And later Attorney Will Isham, of Fowler, was agreed upon as a special judge. The suit was brought to enjoin the auditor and treasurer from paying to Yeoman & Farmer, the contractors, the contract price for cleaning the Dittman or Hodge Ditch, alleging that the specifications were not complied with. The case was first heard by Judge Hanley, who after hearing it the first time was glad enough to let another judge set when the amended petition was filed. Judge Wason was chosen and when the case was called at the beginning of the present term he sustained the demurer of the defendant to the first and second paragraphs of the complaint and granted leave to amend the second paragraph. It is not certain that Judge Isham can hear the case during the present term, but all parties are anxious to have it disposed of, and it may be that he can one day get in on the case and then adjourn it and hear it during vacation, as the next regular term of court is not until September.
