FIRST DEGREE MURDER CHARGE
Grand Jury Returns Indictment Against Dan Day and His Trial Is Set For Nay sth. The grand jury which adjourned shortly after noon Wednesday returned nine indictments, only two of which have been made public. One of these is against Dan Day, the murderer of Daisy Phillips, and the indictment is for first degree murder. He was brought before the court just after noon today, Thursday, and the trial was set for the fourth Tuesday which is May sth. Dan has fared well since he was taken to jail and be looks as well as he ever did. He probably does not realize the magnitude of his crime. After the date of the trial had been agreed upon he
accompanied the sheriff Into the room adjoining the court room and sat there smoking his pipe. Another indictment was against Fred Barger, of Jordan township, son of Ben Barger. He is alleged to have shot and killed one and crippled three other sheep belonging to Tom Reed. He was brought Into court and gave bond In the sum of SIOO, with his father and William Bringle, as Burety. Warrants have not yet been served in the other owes, but It Is understood they are all against Robert Parker, and that all charge him with embezzlement.
