Hodge Ditch Case Up Again

Judge Wason, of Delphi, was on the bench today, and Judge Hanley was occupying the chair in Judge Wason’s court at Monticello. The case here was the now somewhat noted Hodge ditch case, which entered the court in the shape of an Injunction to prevent the payment to Yeoman & Farmer for cleaning the ditch, the parties who filed the Injunction claiming that it was not cleaned according to specifications. The contractors each filed a demurrer to each paragraph of the complaint, and argument was heard on these demurrers, the contractor’s attorneys claiming that the complaint did not constitute sufficient cause of action. Judge Wason took the case under advisement until Saturday, which means that the case will go over tq the April term of the court. If the demurrer is sustained by the court the plaintiff will probably file an amended complaint on appeal to the higher court The contractors have about $4,500 tied up in the ditch.
