Quail Decision is Withheld. » 1 —* The case of Henry F. Dudley, the colored waiter whp served quail to Game Wardeds Martin and Stonebruner, was tried before Judge Hanley he is trying to decide whether the offense was committed in this or in White county. Martin testified that he in company with Game Warden x Stoneburner on December 2nd boarded the dining car on Monon train No. 30 to get supper. Glancing over the menu they noticed that for 50 cents each they would be served with quail. He and Stoneburner both ordered and were served some place between Monon and Rensselaer. He was asked If It tasted like quail and he replied that it tasted like h—l but he didn’t notice any of that on the bill of tare. When the train stopped at Rensselaer they arrested Dudley on two charges but one was dismissed by the prosecuting attorney. Dudley testified that he served them quail but that it was In White county. If this is true the case must be tried In that county. j Judge Hanley has taken the case under advisement
