Be Careful When You Trade Horses
The supreme court recently decided a case regarding the concealment of a defect in the soundness of a horse, in a “hoss trade” that is of interest to people all over the state, and we herewith give the opinion in abstract: “(1) Under Acts 1907, Vage 100, the oonoealment of a defect er disease with which ahorse is known to be afflicted, when it is sold or traded or offered to be sold or traded to a person ignorant, thereof, is criminal, when he is merely passive by failing to inform the purchaser of such disease or defoot, ak, well a« when a trick, artifice, drug, etc., is used to conceal the Satue, (2)' It is not essential, in charging an offer to sell or trade.a diseased defective horse without making its disability knowt* *%> allege in* the affidavit or 4 edict'! input that the saee or trade • was ■o* a»Uy.*< consummated. l££dlej and Gilley, Judge* disputing, hold thabto constitute si the tofiento under miff statute, a completed: sale or exchange !* necessary.” ;
