DEFENDANT GETS BENEFIT VERDICT
Logan Wood Sned by John F. Judy for $5,000 Gets Judgment for SBOO. A rather unusual result of a suit wherein the plaintiff sued on a claimed debt and the defeudant was given a judgment against the plaintiff for SBOO, was tried in Kentland this week. The defendant was W. L. Wood, of Parr, and the plaintiff, John F. Judy, of Judyville. The suit was for some months between Judy and Wood, who operated in Rensselaer and thruout Jasper county. The following from the Kentland Enterprise tells how the case was tried; * ; ■ \ ' - '' ' The Suit of most importance tried in the Circuit Court this week, both-by reason of the time occupiedin its hearing and ot the parties en gaged, was an action bronghtJby John F. Judy—of more or less fame thru northwestern Indiana by reason of his extended business operations and trading propensities —against his business partner, W. L. Wood, on a contract of settle_ment made in 1904. The suit was brought to this court from Jasper county and its Shearing occupied nearly three days. Hon. Eli Stansberry Of Williamsport and At torney T. fi. Cunningham represented Mr. Judy, and Judge Darroch, and Attorneys Foltz and Williams of Rensselaer appeared for Mr. Wood. Judge John M. Lairy of Logansport was on the bench. Judy set out in his com plaint that Wood had guaranteed payments of a large bunch of old notes left over from their loan and mercantile business since 1898, and submitted a contract to bolster up his claim. Mr. Wood said the con tract was not a true one, and in his tnswer produced a contract which he claimed was the original and only true one between himself and Mr. Judy. In substance Judy claimed Wood owed him $5,000 while Wood claimed the balance stood in his favor to the extent of $2,500. Applying Mr. Judy’s motto it seemed to be a case of botb parties “doing more than they had agreed,” and the matter was turned over to the jury to wrestle "with yesterday afternoon, and they returned a verdict of SBOO for Mr. Wood.
