The Circuit Court.
The much litigated ditch case of Wells et al vs Tudor et al was tried Tuesday and Wednesday by Judge Palmer without a jury. This is a proposed tile ditch ia Barkley Tp., only about a mile and a quarter long, but it has been provocative of much litigation and contention. The decision of Judge Palmer is hat the ditch shall be constructed as laid out, and that the assessments of the viewers shall stand except as to Mr. Tudor’s assessment Which is reduced SB7 and Mr. Wells, which is reduced $36. There were three other cases which Judge Palmer expected to try this week, but which were all continued for the term, for one reason or another, mostly because the out of-town attorneys interested in them failed to be present. Judge Hanley iuti mated that there would be something doing if these dilatory tactics were not stopped in some of these old cases, especially that of Isch vs. Tribby. The other cases continued wqre Collins vs Warner and Gleason vs Wickizer. There being nothing further for Judge Palmer to do he returned home to Montioello ou the early train oa We Tuesday morning.
