To Test Diving of Passes.

The right of railroads to issue passes andgthe constitutionality of the railroad commission law are involved in a test suit on an agreed statement of facts that was filed in the Marion county courts lately. The case will be carried to the Unired States supreme court to determine the constitutionality of the law and the agreed statement of facts has been in course of preparation for several months. One of the points relied upon by the railroads in attacking the constitutionality of the law is the exemption of interurban electric lines from the operation of the law.
