The Circuit Court.
Judge Palmer made up the issues in the isch vs Tribby case Friday, and then set the trial f< r the third Monday of the February term, it required nearly the entire day to make up the issues, the attorneys in the case having filed about every kind of legal paper known to the profession. A deal in land in Mil roy tp., is the basis of the suit, and in it one party is suing for the return of #5,000 he paid on the land; while the other is suing to „ compel the former to pay the other $2,000; the agreed purchase price of the farm having been $7,000. Wilson & Quinn, of Lafayette, are the attorneys for isch and Crane & McCabe of Crawfordsville, and Foltz & Spitler, of Rensselaer, for Tribby. The case of James H. Chapman, trustee of the McCoy & Co., bank vs Albert S. Keene, was sent to White county, on change of venue. Mr. Keene was formerly trustee of Wheatfield tp., for five years. He was security on a note of about $l5O which his ‘father, Hoffman Keene, owed the bank. He banked his township funds with the McCoy bank, aud claims that in considei ation of so doing his father’s hote was to be cancelled and delivered to him. However, when he called for the note, McCoy could not find it, but when the bank busted, Mr, Chapman did find it, and sued the endorser , A. S. Keene for its collection. The case was tried and the jury tound for Keene; but a new trial was granted, and now change of venue is taken, as stated. Judge Palmer is over from Monticello finishing the Moffit ease, and Judge Hanley will be over there the first three days this week, finish ing up"a big gravel road assessment ease, he partly tried a month or two ago. «
