STEWARTS SUE FOR THEIR $2,500.
H. H. Stewart & Son have brought suit in the circuit court against W. L. Lewis, for the return of their $2,500. The circumstances upon which the suit is based are familiar to most of our readders. The Stewarts bid off most of the work when the first attempt was made to sell the Iroquois ditch on August 4th. They handed to Mr. Lewis a check for $2,500 as a guarantee that they would complete the sale to them by giving bond. Afterwards they refused to give such bond, claiming Jhat the sale to them was illegal, and demanded back their $2,500. The commissioners at their September session also refused to ratify the sale made August 4th and removed Mr. Lewis as engineer and appointed M. B. Price. Mr. Lewis cashed the check for $2,500 at the State Bank of Rensselaer,'and according to the allegation of the complaint, he had it credited to his personal account. TheI’Stewarts 1 ’Stewarts now sue for the amount, for six per cent, interest on the same and attorney fees, their total demand being for | $3,000. They make the State Bank a party to the suit, as being cnstodians of the money.
