Francesville R[?]itroad Case Decided.
The long fought suit for possession of the Francesville depot grounds has again been decided in favor of Attorney Hathaway and Steis of Winamac, Winfield of Logansport and Spencer of Monti cello says the Winamac Democrat. Judge Raab of Williamsport, setting as special judge at Monticello, rendered a decision that the lands belong to Mr. Hathaway in fee simple, that the Monon railroad company has no right in or to the property, that whatever interest the railroad had in the property has already been adjudicated by a deci sion made some time ago by the appellate court, and that Mr. Hathaway is entitled to a permanent in junction to prevent the company from interfering with his possession of the property. Most people are familiar with the various features of the long legal fight over the property, so there is no use to go into details now. It is believed by many that this will be the end of the hiatter, and that a settlement will now be reached between the company and the four attorneys interested.
