A Complicated Land Case.

Another suit for possession of land was tried Tnursdav btfore Squire Irwia and a j ry. The plaintiff was Wm B. Austin aid the defendant John Baker aid wife. The land is a 160 aore farm near V»rgie, formerly owned by Edgar J. Hurley. Mortgages covered .the face thereof, like nettles ihe garden cf the slothful, and the vineyard of the man devoid of understanding. KiDgman & Co , of Illinois were holders of one of tbese and Mr. Austin of another. Tne land was sjld by the sheriff Marcn 19th, 1904 and Mr. Austiu bought it. The yeir for redemptioi ex pired on March 19tb, of this yiar. Last fall however F 1 z A Spitler as agents for Kingman & Co. rented the farm to the Btkers for the 1905 When the year fir redemption expired, the Bakers were thereup notified to vacate the farm, which then belonged to Austin, bbsclutely. was tried, Thursday. The jury decided in Austiu’s favor. The defendant’s attorney asked for 6tay of judgement on the ground that a justice of the peace bad no j ins die ioa. The contention was that unless the relations of a landl rd and tenant had previcu ly existed between the plaint ff and the defendant, theu the justice hpd no jurisdiction, and tbe cate must be bsgun in the circuit ocurt. Ihe Bquire held this co ntent on good, and decided that h s court had no jurisdiction in tbe case. Tuerefore the judgment of Thursday was set aside, at the plaintiff’s cost. To get possession cf tbe land now it will therefcre be necessary to begin a wholly new suit in the circuit court.
