They bought the Ketchmark sa'om and ball building a year or two ago, expecting to continue the saloon business, but failed to get a license and the old man opened a meat market, That they kept some beer for home consumption was not disputed. The complaining witness was Aaron Ciaspell, a carpenter. He claimed that the old lady had sold him a quart bottle of beer for 15 cents. She said she refused to sell him any beer but simply leaned him a bottle, which he agreed to pay back, when his next private shipment of jeer get along, but thet hp had never dene so. There was also some evidence from Clasped that he bought a whole case of bottled beer out of the Steichel’s shop. They said it never was in their shop, that it came direct to Ciaspell and he wheeled it direct to his home from the depot. He admitted on the stand having received two casas of beer in this way, The jury was out from three to ten p- m. and then reported they were hopelessly divided, and were discharged- There was some evidence to support the theory of the defense that Ciaspell was after revenge because Steichel refused to rent him their hall for a d ncs last Christmas.
