PINED FOR SELLING TO MINORS.
The trial of August Boienbaum on the charge of s< Un g liquor to a minor was held. Friday afternoon bes >re Squire 8 C. Irwin Joe Ellis, who works for B. 8. Fendig, poultry and junk deal-r, was th- oi mplsi-iing witness J e gwoie that on the evening of Jan 26th when he went home to supp-*r his wife told him that their li year old son Frank had been home before him and showed that he had been drinking. Joe went up town and was informed that his boy and tome others were up in the opera home, having a big jamboree. Joe stati s that be concealed himself in tie rear of the opera house and soon saw his ton s ipping along with a bucket and go into Rosey’s saloon. Joe says be followed and gc ing to the side door looked through the glats and saw his boy buy beer and hand the pay over the counter He •ontinued to wa’ch and saw the boy make two more trips, with the growler. Two of these times he says Billy Frey tided the can for the boy, and once R isey himself. Young Ellis testified that he and three other be ys were making a day of it and that he made in all s x trips for beer, and that Frey fill- d the cun five tithes and Rosey on< e. Grover Mackay testified that be was one of the boys, atd that they chipped in f r the b> er and Frank went soma place and toughtit. For the defense Mr. Rosenbaum testified that he was looking after the filling of bis ice home, all that day and was not in his saloon at all Also that he knew ihe E li* boy was a minor and always fired him out. Several stand t>y cust©rmers testified ihey had ceen in Rosey’s p ace all day, and und' 11 o’clock at night and nev r an Euis boy with a growler had they seen there. The Squire d'-oidtd the evidence justified a conviction and he therefore assessed the minimum penalty allowed by la-v a fine of S2O and coeis, or a little less than S4O in all.
