The Indiana Supreme court has held that the faot that a fire started in the grass sixty feet fr im a railroad traok immediately after a locomotive has passed by without any other apparent cause than sparks from the e giue, and that it.was proved that an engine with a proper spark arrestor woo’d not inrow sparks so far, were sufficient grr n Js for holding the railroad li4) ion account Gs the damage done by the fire. The court said that railroads have a right to use fire in operating their trains, but that if there is any reasonable means by whioh they can avoid .cansing damages to property along their tracks the railroads mast make use of anoh means.
