Morris M McCullough, V Be it known that on the 31st day of October, 1904, the abore named plaintiff filed in my office bis complaint against said defendant, to gether with an affidavit In garnishment against one Horace Marbie, together with the affidavit of a competent person that said defendant. Morris M. McCullough, is not a resident of the State of Indiana. That a summons waa issued to the Constable of Wheatfield Township, Jasper County, Indiana, notifying said defendant to be and appear in court at ten o’clock A. M., on the 10th day of November, 1904. to answer said complaint; that oh the 10th day of November, 1904, said constable returned said summons “not found”; that money to the rum of 870.11 has been garnisheed in said action: Said defendant.
