THE CIRCUIT COURT.
Both the appellants in the b : g Iroquois ditcn case, the Motion Railroad and B. J. Gifford, asked for a change of venne from Jaeper county and the cases were eent Io Newton oountv. Some attempt was made to effect a compromise with the railroad, but President Mo Doe! sent a personal order forbidding the compromise on the terms suggestedJames Wiseman, the Aix storekeeper, and widespread hux'erwagon perambulator, was tried on the charge of forcib'y hugging, and breathing ardent but anwelcome words of love in the ears of, one Mrs. John Mohler, James was tried on this case before his honor Sqcire Thornton, of Rensselaer, a month or two and found guilty but took an eppeal. The woman’s evidence was to the effect that Wiseman made his alleged demonstrations while they were in her house and she was reaching for a bisket of newly coined eggs, wherefrom to pay James for a ten cent cm of hominy alleged alec, nut to have been of the latest vintage. Wise man denied the woman’s story, in tote, and declared be was never inside the house. The jury quickly agreed on a verdict of not guilty.
This same Mr. John Mohler as mentioned above, was tried Tuesday afternoon, and Wednesday forenoon on the charge of arson, on indictment bv the grand jury. An empty house belonging to Harry Gifford, in Birkley Tp„ was burned on the evening of Sept. 12tb, Mohler bad lived in the house once, and had been evicted by Gifford. Some parties testified they hsd heard him make threats to get even with Gifford, and several swore they saw a horse and cart like Mohler owns, hitched near the burned house that evening. Others testified to following the tracks of the cart to and near Mohler’s present residence. The jury at first stood 9 for not guilty to 3 for conviotson, but soon agreed on a virdict of not guilty, and the defendant was discharged. The grand jury was discharged from their labors Wednesday morning, In all they returned 28 indictments. Of these about 20 were against the McCoys and Walter White on account of the bank failure.
