The Butler vs Foresters’ Case.
The case of Mrs. Martha Butler, of Rensselaer, vs the High Court of the Catholic Order of Foresters was tried Tuesday, before Judge Hanley, without a jury. The substance of this oise has been already related. John Butler, husband of the plaintiff had been a member of the order, with the usual SI,OOO life insurance 'policy, for quite a number of years He went west in 1898, aad the last beard from him was a letter written by him from Pueblo. Colo., in 1898, in which be announced his firm determination to go to the Klondike. Mrs. Butler kept up his payments in the order and now asked that he be declared dead, and the SI,OOO of his policy ordered paid. The Foresters did not contest the payment, but wanted the authority of a judicial decision, so that if Butler ever should oome back, he could have no legal claim on the order; the suit thus being what is called, a friendly one. The judge decided | that Butler was dead and ordered the SI,OOO paid te the plaintiff.
