Dedication of a Highway.
The Indiana Appelate court has just handed down a decision as to what constitutes the dedication of a public highway, in the way of permitting without objection the use of a strip for such purposes. The decision in substance is as follows: Long continued use of a roadway by the public is sufficient evidence of acceptance. If the acts of the owner are such as to lead an ordinary prudent man to infer an intent to dedicate and they are so received and acted upon by the public, the owner cannot after the acceptance, by the pub io recall' the appropriation. When the highway ia beneficial to the public an acceptance will in general be implied. Evidence tending to throw light in connection with all the other circumstances proven upon the manner the alleged street wag regarded is competent .evidence.
