Will Be a Big Trial.
It is now estimated that the Dr.' Spencer will case, from Monticello, will occupy two weeks for its trial at the February term of our circuit court; which will make it one of the biggest trials held since the Brown vs Monon Railroad damaged suits from Lake county were tried some years ago. The Indianapolis Journal has the following dispatch in regard to this case:
Rensselaer, lud., Dec. 1.—The Dr. William Spencer will case continued to hold the attention of the court until today, when Jbdge Rabb ruled upon the motions of the plaintiff filed and argued on yesterday, and entered an order requiring the defendants by Saturday or this week- to place on file with the clerk of the court for the inspection of the plaintiff the will which one of the defendants admitted on examination to have been made by the testator two months prior to the will in controversy. The court also ’entered an order requiring tho fo\ir defendants, Mr. and Mrs Carson and Mr. and Mrs. Mefiker, to answer about one hundred questions which they had, on examination under oath, before a notary, by the plaip - tiff, refused to answer. These questions related largely to the charge of fraud, undue'mfluenc.e and conspiracy. J udge Rabb set the case down for trial Feb 15, 1904. From one- to two hundred witnesses will be called. . ‘
