The Circuit Court.

In the chse of the town of Goodland against John G. Perry, tried last week" the court decided in favor of the town, giving judgement for $75.98, and a foreclosure on the lot* The decision was to thb. effect that long usage had established the line of the street where the town built the walk. In the quo warranto case against S. M. Lemoin, of Fair Oaks, to enquire into what right he had to hold theoffioe of a justice of the peaoe, the case came before Geo. A. Williams, as speoial judge. The defendant filed a demurrer, which was overruled, and the oase then set for trial for Friday- of this week. Later Lemoin filed his resignation as a justice, and the oase against him was dismissed. Lemoin was appointed in Oct. 1901, by the commissioners, on petition, and in the supposition that there was a vacancy in the township. The township already, however, had two justices which is all the law' permits in suoh townships. aud the appointment was illegal. The oase of S. P.
