Supreme Court Sustains the Foot-Ease Trade-Mark.
Justiee Laughlin, in Supreme Court, Buffalo, has ordered a permanent injunction, with costs, and a full accounting of sales, to issue against Paul B. Hudson, the manufacturer of the foot powder called “Dr. Clark’s Foot Powder,” and also against a retail dealer of Brooklyn, restraining them from making or selling the Dr. Ciask's Foot Powder, which is declared, in the decision of the court, an imitation and infringement of “FootEase,” the powder to shake into your shoes. Allen 8. Olmsted, of Le Roy, N. Y., is the owner of the trade-mark “FootEase.” Similar suits will be brought against others who are now infringing on the Foot-Ease trade-mark and common law rights.
