To Break the Goddard Will.
An interesting case, just filed ia the circuit court, is entitled Joshua Goddard, et al vs William G. Stone. The purpose of the suit is set aside one paragraph of the will of the late Reason A. Goddard. When he died about three years ago, he left his residence property to Mrs. Jane H. Kinney, and ia another paragraph willed certain business property on Front street, including an ice house and a poultry house, and the lot whereon situated, to the Stone boy, then about 8 years old, and son of Mrs. Richard Stone, and putative son of Mr. Stone. The Goddard heirs, some 15 in number, now sne to have this last legacy set aside. It is claimed that when the witnesses signed the will, the name of the Stone boy was not in the second pturagraph, but only a blank space, wherein the name was inserted after the will .was witnessed.
The heirs ask that the legacy to the Stone boy be set aside. The suit will not affect Mrs. Kinney, whiohever way it terminates, as her legacy is not called in question, and neither conld she heir any of the Btone boy’s legaoy if it is set aside.
