The Circuit Court.
The case of John A. Patton vs Martin M. Heil, a venue case from ** Newton Co., was tried by a jury. Patton is the poultry and junk man of Goodland. Heil run his branch shop at Morocco. Patton claimed $l5O worth of scrap iron short, at settlement. The jury gave him $32. Benjamin J. Gifforrd vs Churchill, White Grain Co., of South Bend. Plaintiff sold defendant 25,000 bushels of corn, on contract. Later sent 35 car loads more, in 3 different shipments. Plaintiff claimed that one car load had never been accounted for and also that there were large sums due for short weights on the rest. The defendants admitted that the value of one car load was still due, but denied the short weights. The jury took the defendants’ view and gave Gifford judgment only for the oar load of corn, namely $225. , The personal damage case of Vincent Eisle vs John Franscoviac was also tried by jury. Eisle and wife were driving out of Remington, one evening, and the defendant came along with a drove of cattle., Eisle’s horse shied and upset his buggy, and Elsie claimed to have been thrown in the ditch and badly hurt, t pnd’. sued for damages.
