This ordinance shall be in force u P° n the condition that the said Halleek Telephone Company shall Install within the City of Rensselaer, Indiana a telephone system. and have the same In operation as a publi- telephone system by the first day of January 1901. and should said Halleck Telephone Company fail to have the said system so in operation by the said time t' en the provisions of this ordinance shall bO null and void and all rights of said Company hereunder shall -be at an end without any further act on the part of the said City or an'v one for it. Section S. The said ‘Halleck Telephone Company shall set all poles used hi the said s’slem as far as practicable at the margin of the alleys or at the outer edge of sidewalks, and between sidewalks and curbs where It can be done, and the said C mpany shall also avoid as much as possible setting the said poles on the residence streets within said City or in front of houses on the said residence Greets aud the Couni'H sim.ll have the right iu 'shell eases to determine whether f ile poles shall be set at the pl/ee where it is proposed to set them or at some other place, where objection is made by the property owners. All po'es shall be securely set and tamped and be of such height that the wires strung thereon shall be not less tran six feet above electric light, telegraph, telephone and other wires of a like nature which may be strung in said streetsand allevs and the said Comp .ny proposes to stretch this wire ano so as in no manner to interfere with the wire or service of any existing telegraph, telephone or other line. All poles shall be of eedar, reasonably straight and smooth aud no po'es shall be splleed. Tho work of setting the poles and string ng the wires shall be done under the direction of the City Marshal whose orders shall be subject to r, view by the Council. That sa'd Telephone Company shall maintain the poles and wires in first class manner and condition at ail times and shall remove at its own expense without any delay any poles that it may be necessary to rem ve in order to Improve any streets or'alleys; it shall maintain Its wires not less than twenty-five feet from the surface of the street or alley. Section 4. That where the said Halleck Telephone Company shall furnish their service at the residences of the citizens of this City they shall not discriminate be'ween the said citizens nor between the said service and any other class of service in said City and it shall at all times furnish all of Its patrons first class service which is to be such service as is usually furnished by well, equipped, managed and regulated telephone companies in cities of a like size as Rensselaer. Indiana, may' be during the continuance of this ordinance.

Section 5. Tbe Halleck Telephone Company shall furnish their services at the residences of the citizens of tbe City at the cost of not more than sixty cents per month tor each phone for eacli residence and not more than ()'ie and 20-100 (SI 20) dollars per month for eaeh vlrom? furnished for office, business o r other use within the said City: and all the patrons of said Company residing within tile limits of tlie City of Rensselaer. Indiana, shall have the free use of Xbe owned or leased service of said Company within tile radius cf ten miles of the said City. Section 6. The ssid I’alieek Telephone Company shall furnish to the City of Renss--leer the free use of one telephone at the City Electric Light Plant and one at the City Hal] of said City, giving the said phones the same privileges that are enjoyed by the patrons of sa d Company. Si ctton 7 The provisions of this ordinance shall apply to said Telephone Company wl.en It is Installing its telephone system for the first time and also at all subsequent times during the contlnance of this franchise; an 1 they shall bind any successor to the interests of said Halleck Telephone Company at any time while this - ordinance continues. Sect on 8. The franchise given by this ordinance to the said Halleck Telephone Com p iny shall not be assigned to any one without the consent of the Council of this Ci'y to such assignment, being first procured. Section 9 All of the provisions of the laws of the State of Indiana applicable to public telephone companies incorporated according to the provisions of the statutes shall apply to the said Halleck Telephone Company in the e< joymentof this franchise, and all of the pro. visions with reference to damages and penal tics for discrimination shall appl ■ to said Company in the enjoyment of this franchise, and its failure to submit theretoor begoverm-d thereby shall be a cause for the forfeiture or this franchise. Section 10. Upon the failure ot said Company to comply with either of the provisions of tills ordnance at any time during its continuance the Common Council sha 1 have the right to declare forfeited and at Hn end all of the right of said Company or any of its successors to Its interests under this ordinance. Section 11- This ordinance shall be in force and effect from and after its passage and publication as required by law. Rensselaer, Indiana, July 19, 1909. I, Schuyler U. Irwin, Clerk of said City of Renssela-r, Indiana, do hereby certify the foregoing to be a full, true and complete cony of Special Ordinance No. 43 as adopted by the Common Council of said City at a regular meeting held on the 26th day of March, 1900 as appears from the original ordinance on tue and on record in my office. Notice ot Resolution to Improve Cullen and Forest Streets. Notice Is hereby given, that the common council of the City of Rensselaer has adopted a resolution declaring that it is necessary to improve Cullen street from the north Jine of Washington street to the ■ orth end Of said street, and Forest street to the south line of Oak street by the construction of a macadam stone roadway thereon. The first three hundred feet of said improvement north of Washington street to be from curb to curb, twelve inches in depth 4n the center and tqn Inches on side, with concrete curb. The remainder to be thirty feet wide, with an oak curb The same to be ten inches di ep in the center and eight at the sides.
