The Circuit Court-
Wm. B. Burford has taken a change of venue in his suit against the county for ballances alleged to be due him on stationery and blank books. The case is sent to White county. The divorce case of Eliza A. Marion vs. L. D. Marion was tried Tuesday afternoon. The defendant was willing the plaintiff should have the divorce, which was granted her. Also alimony, whioh was fixed by agreement at SI,OOO in money and a considerable quantity of household goods, provisions etc. The parties have only one child, Rosa, 18 years old, who will remain with her mother. Both however have children by former marriages. They lived together nearly 34 years. Fred Anderson and his wife living near the south end of River street, in Rensselaer were tried for keeping a tough joint Several witnesses testified that the place had a bad reputation, and the neighbor across the street told of a big disturbance there after midnight Saturday, and to hearing a shot fired and a lot of drunken men cursing and blackguarding in the yard, The main witnesses however, those who were there that night would not testify as expected and'the accused were acqnitted. An appeal to the Supreme court has been taken by John Makeever in the ditch oase from Newton township cf Martindale vs. M - keever. Epbriam Fleming was tried for the double purpose of determining his capacity to manage his financial affairs, and also the question of his sanity. All the members ,of the family testified to their belief that he was insane and incapable. In support of their opinion, mentioning such matters ns his great restlessness of nights, getting up after an hour or two in bed, building fires, cursing and swearing at everything and everybody, going to the barn and beating his stock; abusing and threatning his family etc. Also that in some way, he got away with most of tho products of his farm and his $24 per month pension, without much visible return. On the other hand several business men of Rensselaer 'testified that Unole Eph saemed all right mentally in his dealings with them, and Dr. Berkley’s opinion was on the same side. Judge Thompson held that Mr. Fleming was no longer capable of managing his property affairs, and will appoint a guardian. Further than incapacity te manage his property, the judge decided that he was not insane.
