A Gooseberry , Case.
Squire Burnham is not looking for trouble, and don’t have to. Trouble enough comes to him of itself. This time it was a gooseberry trouble, and it covered two townships, Marion and Milroy, and was decided Monday evening. David M. Waymire, of southeast Marion had Mrs. Annie Johnson, of Milroy arrested, charged with picking and carrying away ten quarts of gooseberries, which grew near the road, on his land. The defendant stated that instead of being ten quarts it was only enough to make two pies. Whether the dimensions of Milroy township pies was in evidence is not stated. The law as it applies to gooseberry cases of this character, requires that the defendant, if found guilty, must pay not a fine and costs, but damages and costs. The court found against the defendant, and assessed damages against her, for the benefit of the plaintiff, of 50 cents and the costs. The latter amounted to sls but were voluntarily reduced to $8.84. The defendant gave bonds for the payment of the damages and costs, and was released.
