Gifford & The Trust Company.
The suit of B. J. Gifford against the Provident Life and Trust Company, of Philadelphia, Pa., is pending in our circuit court. In this case Mr. Gifford is the plaintiff, and not the defendant, as was previously erroniously stated. Mr. Gifford got a loan of the company, and was afterwards asked to pay a certain commission, which he refused to do. The company insisted and he insisted on paying the loan off, at once. The company then demanded attorney’s fees which he also refused. He then made tender of the amount which he considered due the company. They refused to accept it, and he brought suit in our circuit court to compel them to accept what was due, and to cancel all mortgages. It was at this stage he paid into the court here the big bag full of gold coin, which made the case notable, and which gold still awaits the defendants in McCoys’ bank. The Trust company made a motion to have the case transferred to the U. S. district oourt, at Indianapolis. This motion the court denied; and now the defendants are endeavoring to have the U. S. court take the case anyhow.
