Mr. Spencer said no party feeling entered into the consideration be should scorn himself if he could allow party, feeling to infloenco him upon such an 'occasion, Mr. Evarts leaning forward, remarked, 'Yw' scorn' himself." Mr. Evarts con tinued commenting on' the' argument of Manager. Butler, that the - Senate was not a Court, , and stepping forward exclaimed, "If this is not a Court it is a scaffold, and you Senators are headsmen." A feeling of awe ran through the whole chamber and , thrilled every hearer. "Ab Seftafdrs, y 6a are told by the Hon. Mr. Butler, that you are not bound to observe your judicial oaths. "I, tell you,' said Mr. Evartsk"and I tell you upon high authority, that 'thou shalt not take the name of the Lord thy God in vain, for the Lord will not hold him -guiltless who '' taketh His name in vain.' " The effect of this quotation can better be imagined than described. A more - solemn -scene was never witnessed in Court or Senate, and under its influence the Senate adjourned. We do not wonder that Manager Butler, ..disappeared when the , honorable counsel converted the Senate Chamber into a stage; bat when' he1 reached the point where he erected the Court, into a scaffold, and appointed the Senators as headsmen, ,, he should, have had the "Beast brought in instantly and 1 made' an example of. v. . j. . The reference to , the . . Scriptures, . though perhaps a little out of the counsel's line, must have had a' telling effect, as the Court instantly , adjourned. Perhaps if he had quoted from Shakspeare such sentences as these: "Shake not your gory locks at me, thou canst ' ijot say , that I , did it;" or, , "Treason has done its worst;" or, better still, Lay on,' Mecduff, and d d be he who first cries Hold! enough' they doubtless would have settled the matter for President Johnson, and been more pertinent to the points of la w' under discussion. ;.'; . The action of Senator Yates, in making public confession and renewed vows of reform, has been criticised somewhat harshly by, many,' journals as . unbecoming, and an evidence of weakness and lack of pride. But it can hardly be looked at sincerelyin that way. The leading weakness .was that, of ; only too many men (who live in, or often visit glaSi'lifcuses), and, if he was" earnest, in his late resolve, it was not when we remember the. repeated references to his habit in the Illinois . papers either especially wealc'-or unflttinr that he should make public answer and apology, both in justice to his constituents and himself..- Had he merely - resigned he would hare retired . to f . private', life with publio stigma that no after freedom from the habit could have removed, and . this would, " as" he says, have been unjust to his family and his own reputation,.
