DISMISS ONE WILL CASE AND SUSTAIN i ANOTHER AT EATON
I EATON, Ohio, May 15. Two will cases were disposed of Saturday in common pleas court, one case being dismissed and a Jury sustaining the will in the other case. In each case it was averred the will of the decedent was not the last will. The dismissed suit was that of Verner C. Wagner, who contested the will of his late brother, Frank C. Wagner, who committed suicide March 24, 3920. Defendants to the action were James A. Longnecker, father-in-law of the testator; trustees of Mound Hill cemetery, Y. M. C. A. of the United
States of America, and J. E. Flora, exe
cutor of the will, he case was dismissed ab the cost of plaintiff, who was the testator's only heir." he other case was that of Frank F. Rhea, who contested the will of his eister, the late Alice E. Kelly, who died Nov. 14, 1919. John Clement White, of Dayton, a nephew of the testatrix, and 15 other legatees and devisees and H. Li. Risinger, executor of the will, were defendants. Mrs. Kelly was the .wife of, the late George H. Kelly, of Eaton, insurance man and at one time mayor of Eaton. A case styled State of Ohio, ex rel H. C. Robinson versus Charles Longman, et al., has been dismissed without record at cost of the plaintiff. The case involved a temporary injunction against defendants cutting shade trees along a sidewalk in Eaton. The court

It is expected a definite program for the day and night will be mapped out in a meeting on May 10. Escape Serious Injury. When a Pennsylvania freight train wrecked a big motor truck here about noon Friday on the Main street crossing, the driver of the truck and three steers that were being transported in
the truck escaped injury. The truck is the property of Roy McCoy, of Eldorado. It is practically a complete wreck. The steers were being conveyed to the market in Dayton. It is said the driver escaped injury by jumping after the motor went "dead" on the crossing. A watchman is stationed at the crossing. Accepts Dixon Position Arthur R. Pitsinger, for a number of years principal of the Eaton schools, has accepted the superintendency or the centralized schools of Dixon township, and will take up his work at the beginning of the school year next fall. Organize Against Burglars One hundred merchants and busi
ness people in Eaton have banded themselves into a protective organization against burglars. The organiza Otion will offer $100 reward for arrest and conviction of anyone burglarizing the places of business of any of the members. warm weather, low prices ruled and small receipts were common, says the Shurley stock yards report. The In

The yards received 230 hogs which weighed 46.5S0 pounds and were valued at $4,751.15; also 14 steers fed by Harry Smith, of Centerville, which averaged 1,050 pounds and brought $7.50. Cows sold for $4 to $5.50 and 75
calves delivered on Saturday, sold for ?5 to $8.
