SLAYER OF FORMER HOLLANSBURG WOMAN GETS LIFE SENTENCE
(Special to The Palladium) DAYTON, Obio, March 30 Recotn mendation of mercy by the Jury Wednesday., saved George K. Smith from the electric chair, after he had pleaded
guilty to a charge of murder In the first desrree. The Jury made the racominendatlon of mercy after Common Pleas Judge Martin stated In opeii court that in his opinion Smith shoui-i be shown at least that much consideration. The 12 jurors then individually stated that they would make such a recommendation. Judge Martin gave Smith a life sentence. Smith shot and killed Mrs. Lillie Smith, his -wife, at the residence of Mrs. Smith. 2348 East Fifth street-
Mrs. Smith lived near Hollansburg before moving to Dayton. Her parents are residents of near Palestine. Smith told the police that he had not been living with his wife for several weeks. On the night of Jan. 28 he went to the Fifth street residence and shpt at his wife four or five times. Mrs. Smith died almost Instantly. Her Kon, Harold Kuntz, lost his right eye when one of the bullets struck him Smith expressed no sorrow for havins? slain his wife, but declared he had not Intended to harm his stepson. Sergeant Detective Walter Cusick brought two letters into the courtroom. They were addressed to Mrs. Lillie Smith, and were signed "Mr. R. A. F." The letters were written in
very endearing terms and were idenU fled ; by Cusick as letters written by Arthur R. Fread,1 348 Troy street. In his examination by police, Smith told them that a man called "Buck" Fread was responsible for wrecking his home life, and that he went to the Fifth street house on the night of the murder with the express purpose of meeting Fread. He said that Fread was not at the house when he arrived, but that he got into an argument and then drew his gun. The introduction of "the man in
the cape," which Judge Martin learned
from transcrips of previous prelum nary hearings led him Ho advise the recommendation of mercy for Smith. - There were four women on the Smith Jury. The first 12 jurors qualified when asked if they would recommend mercy for the accused man. . Harold Koontz, son of the murdered woman, did not appear In the courtroom. He presented himself to Assistant Prosecutor Scharrer Wednea
day morning, and expressed the hope that his foster-father.be given a life sentence.
