SUFFRAGISTS' HOPES REVIVES; TENNESSEE MAY GALL SESSION
NASHVILLE. Tenn., June 25. Suffrage hopes rallied Thursday when It was learned that Governor Roberts planned to call a special session of the legislature to act on the federal suf
frage amendment following receipt of a telegram from President Wilson urging such action in the interests of "real service to the party and to the nation. The governor, however, failed to comment on the constitutionality of the legislature's act should a favorable vote on the suffrage amendment be reached, saying that matter was being discussed by Attorney-General Thompson and department of justice officials at Washington. Purely Federal Matter. "It is purely a federal matter and not a state question," the governor said. " and I have nothing to do with that end of it." The question of constitutionality in the event of ratification would hinge on a clause in the state Constitution which provides that any action on a federal amendment must be taken by a legislature, the members of which have been elected after the amendment was submitted to the state. Members of the legislature to be .called in special session were elected previously to submission of the suffrage amendment to the state by the congress. Some legal authorities, however, have interpreted the recent decision of the supreme court in the Ohio referendum case as invalidating the clause. Word has been received here from Assistant Attorney-General Frierson by Governor Roberts that the Tennessee legislature could ratify the suffrage amendment without submitting the issue to the people. Ruling of Supreme Court. "The ruling of the supreme court of the United States in the recent Ohio cases." said Mr. Frierson, "and the consideration which I gave to this question in preparing those cases for hearing, leaves no doubt in my mind that the power of the legislature to ratify an amendment, to the federal constitution is derived solely from the people of the United States through the federal constitution and not from either the people or the constitution of a state. The power thus derived cannot be taken away, limited or restricted in any way by the constitution of a state."
