Old Indiana Statute Gives County Prosecutor Power to Subpoena Witnesses. INDIANAPOLIS. Aug. 13. Bars handicapping the state and county officials from Catherine evidence to be

used in prosecuting profiteers, were thrown down yesterday when an old Indiana statute was unearthed by Ele j Stansbury. attorney general, which cives county prosecutors power to subpoena witnesses and take sworn statements. The discovery of the statute followed a conference of Governor Goodrich, the attorney general and Dr. H. E. Barnard, Federal food administrator for Indiana, which was called by the Governor to determine if there was some definite way in which evidence could be collected. The Governor announced late Tuesday that he would provide the attorney general's department with finances from the Governor's contingent fund with which to assist local prosecutors In waging war against violators of the Indiana anti-trust law prohibiting combinations from boosting prices or to restrain trade. The Governor also announced that he would provide revenue from the contingent fund to defray the expenses incurred by the state food administrator in giving publicity to the margins of profit on staples. Text of Statute The statute under which the prosecutors will be enabled to gather the evidence of extortion is Sec. 9405, Burn's Revised Statutes, 1914. It

reads: "Whenever any prosecuting attorney ehall receive information of the comrmision of any felony or misdemeanor, he shall cause process to issue to the proper officer, from court having jurisdiction to issue same, directing him to ; subpoena the person therein named likely to be acquainted with the commission of such felony or misdemeanor, and shall examine any person so subpoenaed before such court touching such offense: and if the facts thus elicited are sufficient to establish a reasonable presumtlon of guilt against the party charged, said court shall .cause so much of said testimony as amounts to a charge of felony or misdemeanor to be reduced to writing nd subscribed and sworn to by such witnesses, whereup such court shall proceed to issue warrants for the apprehension of the accused, as in other cases." Violations of the Indiana anti-trust law are misdemeanors. The law provides a fine of $5,000 and not to exceed one vear's imprisonment in the county Jail. ' Whitewater, Ind.
