EATON, O., July 16 Common Pleas Judge A. C. Risinger handed down a decision Monday in the Lola M. Austin will case, application having been made to the court by A. J. Heistant, administrator, with the will annexed, of trre estate, for construction of the will. The court declared Dora Markley Filbert, a first cousin of the testatrix, shall receive the decedentls home on North Cherry street. The item in the will giving to her the property was not clearly defined, it providing that she "or" her daughter, Alice, receive the property. The court held that the testatrix evidently had in mind the possibility of the child surviving the mother and had used the word "or" instead of "and" in the item bequeathing the property.The resi

due of the will was bequeathed to the children of five uncles and aunt3 of the testatrix, or her first -cousins. Thecourt took the view that the intent of the will was the the residue be distributed per capita instead of in onefifth parts. Second cousins are to take per stirpes from their respective parents. The will disposed of an estate worth $66,000, the instrument having ben written by the testatrix herself.
