BRIEF OF DRYS SUSTAINS LAW TO OUST 000ZE Declares Regulation of Liquor Sales Lies Within Police " Powers.
Indianapolis, Marcn 22. The Legislature has' constitutional authority to enact a state-wide prohibition law because the regulation and prohibition of the sale and manufacture of intoxicating liquor lies within, the police power of the state, according to the brief for the dry 3. which is to be filed between now and Saturday with the clerk of the Supreme Court In the Evansville case brought to test the
law's constitutionality. The brief states that the fourteenth
amendment to the Federal constitution will not be sufficient to knock out the. Indiana law, because the United States Supreme Court held In a test case In Idaho recently that "a state has power absolutely to prohibit the manufacture, gift, purchase, sale r transportation of intoxicating liquor within its borders without violating the guarantees ' of the fourteenth amendment." 1 What Amendment Means ' The pertinent part of the amendment states that "no state shall make . or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of ( life,
liberty or property, without due process of law; nor deny to any person within Its jurisdiction the equal protection of the laws." - The brief will be filed over the signatures of. Philip C. Gould of, Evansville. attorney for Edgar Schmltt the appellee; K. C. Minton. attorney for the State Anti-Saloon League, and Ele Stansbury, attorney general. They act as attorneys for Schmltt, who waa restrained by Judge Fred M. Hostetter of the Vanderburg Superior Court from enforcing the. law. The suit was brought by the F. W. EATON, Ohio, March 22. Mrs. Laura Moss, 65, died Wednesday at the home of W. H. Baker, near Lewisburg. She at one time was a resident of Dadsville, east of West Alexandria. Funeral services were held Friday morning at the Progressive Brethren church of West Alexandria. Burial at West Alexandria.
