ARGUMENTS ARE HEARD IN SUITS TESTINGDRY LAW Breweries, Seeking to Overthrow Prohibition Bill, Cite Decision of 1885.

ments in the suits of the Evansville

Brewing Association, the F. W. Cook Brewing Company and Henry Gergenrath, saloon keper, to test the constitutionality of the new stale prohibition law, which becomes effective April 2, were heard in Superior Court today before Judge F. M. Hostetter and the cases are under advisement. Attorneys for the plaintiff based much of their argument on the case of Bebee vs. the State in 1853, when prohibition under the constitution of Indiana was held unconstitutional. In their arguments . they pointed out twenty- seven instances where the defense was upheld and that the same constitution is in force at present. Judge Hostetter, in one remark, showed his attitude on the question of property rights, also argued as a reason for unconstitutionality of the prohibition law. "As I understand the law, the fact that property owned by the plaintiffs is endangered is not alone sufficient cause for declaring the statute unconstitutional," he said. "It would give the plaintiffs reason for complaints, however." The arguments lasted from 9:30

o'clock in the morning until 4:45;

o clock this afternoon. Attorney v. D. Robinson consumed the entire morning session in his arguments while Lane Osborn, prosecuting attorney and defendant in all three suits, argued in the afternoon. Attorney Philip W. Frey also spoke for the plaintiffs in the afternoon. Judge Hostetter had six pages of citation notes when the arguments were completed. Title Held Insufficient The plaintiffs made the additional argument that the title of the act is not sufficient. Eight citations were given as to this argument, the defense replying with one citation claiming the title of the act need not make

more than a general reference to the subject matter. Prosecutor Osborn. again brought up the subject of prematureness of . the suits, giving several citations. Judge Hostetter previously had overruled a motion to dismiss the suits filed by Prosecutor Osborn in the grounds they were prematurely brought. A decision is expected by attorneys within ten days. Judge Hostetter previously had urged that obstructions be swept away. While the hearing today was technically upon demurrers to the complaint filed by Prosecutor Osborn, the merits of the statute are involved and .decision upon the demurrers involves decision upon the suits. In citing the case of Bebee vs. the state, attorneys for the plaintiffs said: '"If this case decided in 1855 under the same constitution which we live under today is to be overruled, it should be by the state Supreme Court. It is the duty of the inferior court to follow courts of last resort. At this hour in Indiana the case of Bebee against the state is a law of courts."

Girl Gets Father, Mother and Husband in One Day KOKOMO, Ind., Feb. 5 Miss Nellie Kissinger, 19 years old, obtained a father, a mother and a husband all in one day. This morning she was adopted by Mr. and Mrs. Frank Cunningham, by whom she had been reared for sixteen years. She had been in ignorance of the fact until recently, when she learned that they were not her parents. She desired to be married under the name of Cunningham and, after her adoption, she was immediately licensed to marry Ernest Diemonsin.

The

forms must he filled out and returned cn or before March 1, 1918, accompanied by Form 1096, which Is a letter of transmittal and affidavit certifying the accuracy of Form 1099. Postmasters, bank3 and revenue officers in the field will have a supply of these forms.
