COMMISSIONER'S SALE OF REAL ESTATE The undersigned. Commissioner, by virtue of an order of the Wayne Circuit Court of Indiana," made and entered of record at its April Term, 1916. being Cause No. 17456 in said Court, in an action for Partition therein pending, wherein Clara Anderson is Plaintiff and Sarah Jane Anderson and James Moore are Defendants, will offer for bale, to the highest and best bidder, at public auction, upon the premises one (1) mile north and threefourths (3-4) mile east of the town of Bethel, Wayne County, Indiana, on WEDNESDAY, JUNE 14, 1916, At 2:00 o'clock p. m., the following real estate situated in said County and State: One hundred and twenty (120) acres more or . less, all of one tract of land and known as the John E. Anderson farm, and specifically described in the complaint and petition in said cause. The buildings on said farm are in good condition. The barn, which is 40x50 feet with 20 ft. posts, was built in 1907; frame house with five rooms. The fences are in fair condition. The water supply consists of good cistern, 22.V ft. driven well and ever-flowing spring r.ar house and barn. Thirteen (13) acres in woods and eleven fll) acres in permanent pasture. This year forty (40) acres in corn, fourteen (14) acres in Big English Clover, seventeen (17) acres in rats and eleven (11) acres in meadow. On the farm is good orchard and small fruit. One-third of the purchase money cash in hand, one-third in one (1) and onethird in two (2) years from date of sale. (6) per annum from date, waiving valuation and appraisement laws and providing for attorneys fees; and to serur ; the said notes by first and purchase money mortgage upon said real estate and by insuring the buildings upon said real estate to their insurable value, or the purchaser may pay all cash. Said real estate will be sold free of all liens except taxes for 1016, payable in 1917,, and subject to the tenancy of James Moore thereon, which is on thr usual grain rent plan, and which tenancy expires February 28, 1917, at which time purchaser is entitled to posession.
