In the matter of the petition of Thomas G. Dunbar, et al., for improvement of National Road, Center Township. Notice is hereby given that on the thirteenth day of May, 1916, there was filed in the office of the Auditor of ; Wayne County, Indiana, a certain ! petition signed by Thomas G. Dunbar. ! and more than fifty other resident and I freehold voters of Center Township, I Wayne County, Indiana, asking for i the improvement and reconstruction i of a certain highway in said Center i Township under what is generally known as "The Three Mile itoaa Law," and which petltion'ls in words and figures as follows, to-wit: PETITION. State of Indiana, County of Wayne, es: Before the Board of Commissioners of Wayne County, Indiana. In the matter of Concrete Roadway Improvement Petition, Center Township, Wayne County. Indiana. Petition No. 2. To the Board of Commissioners of Wayne County, Indiana. Gentlemen: The undersigned, being fifty and more freeholders and voters, and being also fifty and more bonaflde resident freehold voters of Center Township, of Wayne County, State of Indiana, and being Interested in the Improvement of the highways within said township hereby and herewith petition your honorable body for the improvement of a highway all of which Is within said Township by the construction of a cement and concrete highway Improvement therealong as is hereinafter set out, and as is herewith described and recommended, towit: Description. That the highway which it is pro posed and petitioned shall be graded, drained and paved has already been established, and the same is described as follows, to-wit: -Being the highway generally known as "The National Road," and the such part thereof as by the terms of this petition it is proposed to be Improved being the following, to-wit: Said National Road commencing at junction of Centerville and Williamsburg Turnpike and said National Road, and same being also junction of Centerville and Abington Turnpike and National Road, all "being- free gravel roads of said County of Wayne, in Center Township thereof, and said junction point being a short distance West of the "East line of Southeast Quarter of Section Nineteen (19), Township Sixteen (16) North, Range Fourteen (14) East, and continuing thence Westwardly bearing slightly to the South, through the remainder of South half of said Section Nineteen anu uirougn soutn nau or section Twenty-four (24), Township Sixteen (16) North, Range Thirteen (13) East, and close to the North line of the Northeast Quarter of Section Twenty-six (26) of Township Sixteen (16) North, Range Thirteen (13) East, to the intersection of said National Road with the West line of said Northeast Quarter of said , Section Twenty-six (26), the same being the junction of said National Road with "Jackson Hill' Turnpike, same being also a free-gravel road of said County, and said National Road here In described being of lesg than three 3) mites in length, being practically two and one-half (2V) miles in length, and connecting at each end with a free-gravel road, and all within the boundaries of said Township ot Center of said Wayne County." RECOMMENDATIONS That the undersigned, petitioners aforesaid, herewith recommend that said highway as now established shall be graded, drained, paved and improved through these proceedings in petition and subsequent proceedings thereon as follows, to-wit: ' Width. That as to the width of said highway the same being now laid out and established of eighty feet in width, the same shall not be lessened but "shall continue undisturbed by these proceedings or any orders upon this petition hereinafter made.

That as to such places along line ot said petitioned for Improvement as culverts may be necessary that same be constructed as a part of the improvement for the purpose of carriage of surface waters, and of permanent construction and size ample to meet all demands thereon. Drainage. That provisions be made as a part of the improvement of said highway for the proper and permanent drainage thereof, the same by side-ditches where proper, and for tile and storm sewer drainage where proper, and as the peculiar and particular circumstances may require, In the either case. General - Character of Improvement. That the general character of the improvement herewith petitioned for shall be first the stabttsiring of the proper grade of highway, the same agreeing substantially with the present grade In order to conserve and use the materials of present highway and being in conformity with the grades of the other and already existing highways connecting therewith, and also practically conforming to grade of tracks of the Terre Haute, Indianapolis and Eastern Traction Company, which occupy a part of said highway the entire length thereof, and observing the grades as may hereto fore have been established by the municipal authorities of Town of Cen terville; that following such establishment of grade said highway be platted by fixing and establishing the center line thereof, both inside and outside 6aid . Town of Centerville, with the same platting to anticipate the construction of side walks and ways along the each side thereof, to provide for said railway tracks, and for drainage and improvement of roadway as hereinafter set out. Outside Town of Centerville. , That outside said Town of Centerville, the said highway be improved along the. highway and south side of tracks of Baid railway a uniform width of ten to twelve feet by the construction therealong of an earthen roadway, in the same using as far as possible the present materials in roadway and sucli as obtains from excavation for cement roadway hereinafter mentioned. That to the highway and south side of said ten or twelve earthen roadway above, the said highway be then further improved for a uniform width of roadway by construction of an eighteen foot width of concrete and cement roadway the entire length of highway outside said town. That to the highway and south side of said cement roadway the highway be then further improved by the construction along entire length of cement roadway by the construction of an earthen way or berm of same three to five feet in width and of such character of construction as will provide fqr drainage and as protection to said cement roadway. That all ditches and surface drains be entirely without the such improved width of highway as above described. Within Town of Centerville. That as to such Dart of highway as is within the corporate limits of said town of Centerville and wherein said tracks of said railway are located in center of highway, the such length and part of highway be improved by two ten foot widths of concrete and cement roadway of like character as before stated, the one to the either side of such railway track with the edges nearest said track being distant therefrom a uniform distance of eighteen Inches, and the same respecting the franchise rights of said traction "company occupying the. streets of said town. . ASKS $3,000 DAMAGES EATON, O., May 16. A $3,000 damage suit filed by Daniel G. Burkhardt, of Richmond, against Ansel Toney, has been compromised and dismissed from common pleas court without record. It was alleged by Burkhardt that Toney, driving an automobile, ran into a bicycle ridden by the plaintiff. The suit was filed last January. Petitioners further state in presenting this petition that highway referred to is of gravel construction, and that same Is in need of permanent improvement due to. the great use thereof, and being needful of improvement should be permanently improved rather than temporarily improved with gravel or macadam. Petitioners further petition, in view of the permanent character of improvement herein petitioned for, that in the eventual bond issue made and sold to pay expenses of improvement, that such issue be made retirable in fourth semi-annual payments and series. Petitioners further petition that this copy and the duplicates thereof, which are duplicates except as to signatures, may all - be considered as one petition in the presentation thereof. Petitioners further petition that the Board of Trustees' of Town of Centerville, Indiana, may by proper proceedings in the premises transfer authority to the Board of Commissioners of Wayne County, Indiana, by resolution as provided by statute, to order such improvement in the corporate limits of said town, and herewith petitioners authorize their representatives to petition such Board of Trustees for passage of such resolution. Petitioners further state that in the suggestions and recommendations herein made they understand same are suggestions and recommendations only, and that the Board of Commissioners of Wayne County .Indiana, and the viewers and engineer as may hereafter be appointed are not bound hereby, the end the petitioners desiring to reach being always the permanent improvement of said highway of character of improvement which best meets the desires and demands of the uses of said highway, and as have been found most suitable for such and like highways in the permanent improvement thereof. Wherefore, finally, the petitioners herein pray your honorable body for the improvement of the said highway suosianuany as aforesaid, and further request and petition that all the necessary and proper steps be taken and proceedings be had as will effectuate the consummation of the improvement of highway upon . this petition on its presentation as by law provided.
