jected this proposal on objections of

Prosecutor Reller. The court was Informed by Reller that there would only be Underbill's word that he would remain away from Wayne county, that he could not be compelled to leave the county and that it would be unfair for Wayne county to force Underbill upon some other community. The alleged error which is the basis of the petition for a new trial is the action of the court in overruling the objection of the defense to a question

asked Underhill by Prosecutor Reller.

When Underhill was a witness for

testimony be had given had been testified to by him when he was tried' In the Richmond city court. At the first trial Underbill did not take the witness stand, a fact, his New Castle at

torneys averred, the state had n right to bring out, directly or Indirect ly. No Indiana decision covers thii point of law but the defense cited ser erar Texas decisions supporting thet contention.
