DOUBLE ENTRIES SCOW SHORTAGE IN STORE BOOKS
Not only are the alleged shortages I la the accounts of the H. C. HaaeI meter, company shown In the , "caah books," but they are alao shown In the ledger, according to the testimony tot Accountant Scblautterbacb, Tuesday afternoon. Although the account- ; ant baa been on the stand, since Friday morning, not. nntil Tuesday afternoon was any mention made of the entries made In the ledger. The total shortage of $3,204.84, as shown In the 'cash books is also revealed in the audit of the ledger, according to the testimony of the accountant. The , purpose of the testimony of the accountant In going4 over the ledgers of the eompany, la to impress upon the jury that the cashier was evidently aware of the shortage as it was found in : both books and of an equivalent amount. It was balanced in both books by an alleged "double ; entry," but after May 1, 1901, no bal- ' ance -waa struck. ' ' Because of the fact that no balance was' reached by the cashier after ' 1909, all of the receipts and expendlJ tures of the company had to be examined by , the accountant before ar- ' riving at the conclusion that there was a shortage. The testimony regarding the entries made In - the ledger was completed this morning. - When Wilfred . Jessup, the attorney for - the', plaintiff, began .questioning the witness regarding the ledger and offered various items to the Jury for inspection, ' objection was raised by Attorney Ray Shiveley for the defense, who said , that all that had been gone over by the witness in the cash book but the judge overruled the objection. He said that the defense had a right to -go-Into a complete examination of ! the ledger in order to make a comf parlson with the cash books, which is necessary for a proper audit of the 1 books. FINED FOR HUNTING WHiTHniJT LICENSE - Howard Hawekotte, pleading guilty to the charge of hunting without a license in Judge Strayer's justice of the peace court this morning was fined $5 and costs, a total of $21.15. He and Foster Webster were arrested in the yards east of Glen Miller park yesterday by State Game Wardens J. J. Brady and T. H. Sullivan. - ; Foster maintained Innocence when he was arraigned this morning and he w$s released on bail and his trial set for 2 o'clock next Saturday. At this point, John Robbins jumped to his feet and objected to this line of questioning saying that the' accountant would have no right to testify to a conclusion of this kind. "That is the question at issue," said Mr. Bobbins. "That Is our contention, that the money waa taken before it ever reached the. cashier. This witness has no right to testify, to that. It is for the jury to' decide 'why a thing can or can't be done.' " . Objection Overruled. The judge, however, after stating his reasons, which were in substance, that the witness was an expert and had a right to draw conclusions regarding the keeping of books as he had a right to compare the actual conditions with bis experiences, overruled the objections of John Robbins.' Exceptions were taken to the ruling by the defense' and the questioning proceeded.- ; : "It the defense has any objections to that question, it can be brought out in cross-examination," said the judge. Henry U. Johnson then said that in asking the question he desired the witness merely to state his answer as concerning a concrete case, which he had a right to do.
