SUES IN COURT TO ENJOIN BIG LOAN TO ALLIES Policyholder Seeks to Restrain Mutual life From Investing $10,000,000 Trust Funds of Company. CHICAGO, Oct. 13. Alleging The Mutual' Life Insurance Company, of New York, contemplates . investing $10,000,000 of its trust funds in the Anglo-French loan of $500,000,000, Olga H. S. Walsh, of Chicago, holder of a $2,000 insurance policy in the Mutual, has filed suit for an injunction in the Federal Court here.
The complaint, -which was filed by
Mr. Walsh in person, sets forth that among the thousands of policy holders in ,: the Mutual Life. Insurance Company are many persons of various nationalities, and that the investment of the trust funds of these policy holders in : the Anglo-French loan would tend to produce antagonisms , among the policy holders .which might lead to disrupting the company and thereby depreciate the value of her interest in the company. , In the language of the bill the court Is informed that "the solvency of the company and the conservation of the reserve fund depends on the goodwill of the policy , holders and no part of the assets of the company should be loaned or invested in the securities of any warring nations or used for the purpose of abetting existing wars." Would Also Enjoin Morgan. It further asks that J. P. Morgan and J. P. Morgan & Co., be restrained from soliciting or conniving with the officers and directors of the Mutual Life Insurance Company for the purpose of procuring any of its funds to be Invested in the $500,000,000 AngloFrenSh loaft. A' similar rule of court is petitioned against members of the Anglo-French Loan Commission Baron Reading, Sir Edward Hopklnson Holden, Sir Henry Babbington Smith, Basil B.
Blackett, - Ortave - Homeberg - and Ernest Mallet. The court is informed that the Investment is contrary to the statutes, although it is declared the defendant company has already invested large sums in British Colsols, Cape of Good Hope stock and various Austrian Government securities. ' The petition is presented -to the court, in the name of the petitioner and all other policyholders in the Mutual , Life Insurance . Company of New York who may care to join in the action. - ' Alleges Secret Deal. I The bill charges that Charles A. Peabody, president of the insurance company, and George F. Baker, one of, its , directors, met secretly, many times , "at one of the " selected rendezvous '.'lc of J. " P." M organ and the Anglo-French Commission." . pledging the support of the ' company to the loan.
